Why Judge Kavanaugh Should Not Be On The Supreme Court

He was putting the Democratic Party on notice that they should not expect a fair hearing in his court because he would be seeking revenge.

Judge Brett Kavanaugh has been elevated to our Supreme Court, the Court of last resort. There is no doubt in my mind that he should not be on the Court.
Don’t get me wrong, my basis for saying this has very little to do with the events of approximately 36 years ago involving Dr. Christine Blasey Ford. Yes, I believe every word she said in her testimony before the Senate Judiciary Committee. I have no doubt that she was physically assaulted by Judge Kavanaugh and his friend Mark Judge. However, I do not believe that she was in any serious danger of being raped. These two seventeen-year-old punks wanted to humiliate and scare her and they succeeded. Remember, Dr. Ford, testified that what has stayed with her all these thirty-six years is the sound of the two boys laughing at her fear and humiliation. To me, that was what the two seventeen-year-old little punks had in mind and it gave them a good laugh. I would not be surprised that they still high five each other and laugh at Dr. Ford’s fear.
For me, the problem with Judge Kavanaugh and why he should not be on the Supreme Court, or any other court in the land, was his performance in the rebuttal he offered to her testimony. The anger, the screaming, the out-of-control person on full display before the Committee that afternoon truly disqualified him for any court anywhere. First, there really is such a thing as “judicial temperament.” It is an absolute prerequisite for any judge on any court. Judges must always display a calmness and rationality anytime they are in public. The rantings of Judge Kavanaugh at the hearing revealed a man of extreme anger unable to control his emotions while on the witness stand. If a witness in his court carried on the way Judge Kavanaugh did they would find themselves being forcefully removed from the courtroom by an armed bailiff. Judge Kavanaugh did not engender any confidence in his ability to listen carefully and courteously to both sides on an issue and render a calm and thoughtful decision.
Judge Kavanaugh should also not be on the Supreme Court because he is not honest. As a lawyer, I was shocked to see Judge Kavanaugh flat out lie to the Senators during the testimony. And lie about simple things. For example, we all have had our drunken sessions as teenage boys trying to show that we can hold our liquor.  Undoubtedly we also went through the throwing up that follows hard drinking session more than once. Why Judge Kavanaugh had to lie about his was really strange. Had he acknowledged the teenage “barf” parties were all about drinking beer that would have been the end of it. We could have shrugged that off with the old “boys will be boys” rationalization. But to lie and try to mislead the Committee on this matter revealed a man who would lie when he considers it necessary to forward his ambition. And it wasn’t just one little lie, he also lied about the meaning of the quotes from his high school yearbook. To say that when you and your high school football teammates refer to themselves as members of the “Renata” club they are not saying this is a club that admires the young lady named Renata. They are all a part of the “Renata club” means that they have all had Renata and announced it to the world in the yearbook. There is a saying in the law, “if a witness lies about small things they will lie about the big things also.” Judge Kavanaugh lied about things that he could have been forgiven for if he had only owned up to them. Our Supreme Court should be made up of people with impeccable credentials and Judge Kavanaugh is not of that caliber and should not be on the ultimate arbiter of our issues.
Finally, Judge Kavanaugh made clear that he was a political partisan in a way that was most shocking. Judge Kavanaugh told the Democratic members of the Senate Judiciary Committee that they were there to perform a political hit job against him and reminded them that “what goes around comes around.” This was truly alarming, to say the least. He was putting the Bre on notice that they should not expect a fair hearing in his court because he would be seeking revenge. These words from a judge, threatening retribution against a possible future litigant, caused me to drop the pad I was holding at the time. This was truly shocking to hear from a potential Supreme Court Justice.
Anyone of the reasons stated above should have been enough to disqualify Judge Kavanaugh. All three together should be enough to bar him from holding a judgeship in even a small claims court.
